1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Florish ("we", "us", or "our") governing your access to and use of the Florish mobile application and website at https://www.florishsave.com (collectively, the "Service").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18, you are not permitted to use the Service.

3. Description of Service
Florish is a money-saving and investing education application that provides users with an AI chat assistant, daily money-saving tips, a savings tracker, and bite-sized investing lessons. The Service is designed to help users learn about personal finance and develop better money management habits.

4. Important Disclaimer: Educational Content Only
The Service provides general financial education and information only. Nothing in the Service constitutes professional financial advice, investment advice, tax advice, legal advice, or any other form of regulated advice.

The AI chat assistant and all other features of the Service are designed for educational and informational purposes. The information provided should not be relied upon as a basis for making financial decisions. You should always consult with a qualified financial adviser, accountant, or other appropriate professional before making any financial decisions.

We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Service. Any reliance you place on such information is strictly at your own risk. We accept no liability for any loss or damage arising from your use of, or reliance on, any information provided through the Service.

5. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. Subscription and Payments

Subscription Plans
The Service is available through paid subscription plans. Current pricing is as follows: Weekly subscription at €4.99 per week, and Annual subscription at €49.99 per year. Prices may be subject to change, and any changes will be communicated to you in advance.

Free Trial
We offer a 3-day free trial for new subscribers. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Auto-Renewal
All subscriptions automatically renew at the end of each billing period (weekly or annually) unless you cancel your subscription before the renewal date. You can manage and cancel your subscription through your Apple App Store or Google Play Store account settings.

Payment Processing
Payments are processed through the Apple App Store or Google Play Store, depending on your device. All payment terms are subject to the respective app store's terms and conditions.

Refunds
Refund requests are handled in accordance with the Apple App Store or Google Play Store refund policies. To request a refund, please contact the respective app store directly through their standard refund process.

7. User Content and Data
You may create and store content within the Service, such as savings goals, budgets, and other personal financial information. You retain ownership of any content you create. By using the Service, you grant us a limited licence to store and process your content solely for the purpose of providing the Service to you.

If you cancel your subscription or delete your account, your data will be retained for 90 days and then permanently deleted. During this retention period, you may contact us to request a copy of your data.

8. Acceptable Use
You agree not to:
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use any automated means to access the Service without our express permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others or allow others to access your account

9. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Florish and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Limitation of Liability
To the maximum extent permitted by applicable law, Florish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
• Your use or inability to use the Service
• Any financial decisions made based on information obtained through the Service
• Any unauthorised access to or use of our servers and any personal information stored therein
• Any other matter relating to the Service

11. Indemnification
You agree to indemnify, defend, and hold harmless Florish and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by cancelling your subscription through your app store account settings.

13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service prior to the changes becoming effective. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of France.

15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
